Terms and Conditions
§1 General provisions.
1.The online store available at www.angell.pl is operated by a sole proprietorship ANGELL Michał Kazimierczak, address: ulica Nad Wierzbakiem 12/2, 60-612 Poznań, NIP 6182032261, REGON 301611512.
2. These Regulations are addressed to both consumers and entrepreneurs using the Online Store.
3. The Administrator of personal data processed in connection with the implementation of the provisions of these Regulations is the Service Provider. Personal data is processed for the purposes, scope and on the basis of principles indicated in the privacy policy published on the Online Store's websites.
§2 Definitions.
WORKING DAY – one day from Monday to Friday, excluding public holidays.
REGISTRATION FORM – a form available in the Online Store enabling the creation of an Account.
ORDER FORM – an interactive form available in the Online Store enabling the submission of an Order, in particular by adding Products to the electronic shopping cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
CUSTOMER – any entity that has concluded or intends to conclude a Sales Agreement with the Seller.
ACCOUNT – an individual name and password jointly provided by the Service Recipient, constituting a collection of products and data provided by the Service Recipient and information about Orders placed by them in the Online Store.
PRODUCT – a movable item available in the Online Store that is the subject of the Agreement

SALES AGREEMENT – a product sales agreement concluded between the Customer and the Seller via the Online Store.
ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Online Store.
SERVICE RECIPIENT – any entity using or intending to use the Electronic Service.
CONSUMER RIGHTS ACT, ACT – the act of May 30, 2014, on consumer rights (Journal of Laws 2014, item 827 as amended)
ORDER - a declaration of will of the Customer submitted using the Order Form and directly aimed at concluding a Product Sales Agreement with the Seller.
§3 Electronic services in the Online Store.
1. The following Electronic Services are available in the Online Store: Account, Form
Order, Newsletter.
2. Account – using the Account is possible after the Service Recipient completes the following steps: (1) filling in the Registration Form, (2) clicking the "Register" field. In the Registration Form, it is necessary to provide the following Service Recipient data: name, surname, email address and password.
An Account can also be created when placing an Order – in this case, the Account is created together with the submission of the Order.
3. Account creation is free of charge for an indefinite period.
The Service Recipient has the option, at any time and without giving a reason, to delete the Account by sending an appropriate request to the Service Provider, in particular via email to: kontakt@angell.pl
4. Order Form – the use of the Order Form begins when the Customer adds the first Product to the electronic shopping cart in the Online Store. An Order is placed after the Customer completes two consecutive steps – (1) filling in the Order Form and (2) clicking the "Confirm purchase" field on the Online Store's website after filling in the Order Form – until this moment, it is possible to independently modify the entered data (for this purpose, follow the displayed messages and information available on the Online Store's website). In the Order Form, it is necessary for the Customer to provide the following Customer data: name and surname/company name, address (street, house/apartment number, postal code, city, country), email address, contact phone number, and data regarding the Sales Agreement: Product(s), quantity of Product(s), place and method of delivery of Product(s), payment method. In the case of Customers who are not consumers, it is also necessary to provide the company name and NIP number.
5. The Electronic Service Order Form is provided free of charge and is a one-time service that ends when an Order is placed through it or when the Service Recipient ceases to place an Order through it earlier.
6. The Service Recipient is obliged to use the Online Store in a manner consistent with the law and good customs, bearing in mind the respect for personal rights and copyrights and intellectual property of the Service Provider and third parties. The Service Recipient is obliged to enter data consistent with the facts. The Service Recipient is prohibited from providing unlawful content.
7. Complaints related to the provision of Electronic Services by the Service Provider and other complaints related to the operation of the Online Store (excluding the Product complaint procedure) may be submitted by the Service Recipient electronically via email to: kontakt@angell.pl
8. It is recommended that the Service Recipient provide in the complaint description: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the irregularity; (2) the Service Recipient's request; and (3) contact details of the complainant – this will facilitate and speed up the consideration of the complaint by the Service Provider. The requirements specified in the preceding sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description.
9. The Service Provider responds to the complaint immediately, no later than within 14 calendar days from the date of its submission.
§4 Performance of the sales contract.
1. The conclusion of a Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Online Store.
2. The price of the Product shown on the Online Store's website is given in Polish zlotys and includes taxes. The Customer is informed about the total price including taxes of the Product being the subject of the Order, as well as the delivery costs (including transport fees, delivery and postal services) and other costs, and if the amount of these fees cannot be determined - about the obligation to pay them, on the Online Store's websites during the order placement, including at the moment when the Customer expresses the will to be bound by the Sales Agreement.
3. Procedure for concluding a Sales Agreement in the Online Store using the Order Form:
I. The conclusion of a Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order in the Online Store.
II. After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order is made by sending an appropriate e-mail message by the Seller to the Customer's e-mail address provided during the order placement, which contains at least the Seller's statements about receiving the Order and accepting it for execution, as well as confirmation of the conclusion of the Sales Agreement. At the moment the Customer receives the above e-mail message, the Sales Agreement between the Customer and the Seller is concluded.
III. The recording, securing, and making available to the Customer of the content of the concluded Sales Agreement takes place by (1) making these Regulations available on the Online Store's website and (2) sending the Customer the e-mail message mentioned above. The content of the Sales Agreement is additionally recorded and secured in the Seller's Online Store IT system.
§5 Payment methods and terms.
1. The Seller provides the Customer with the following payment methods for the Sales Agreement:
I. Traditional bank transfer to the account indicated by the online store.

II. Electronic payments and credit card payments via www.payu.pl
III. Payments via PayPal.
IV. Cash on delivery.
2. Payment deadline:
I. If the Customer chooses payment by bank transfer, electronic payments or credit card payment, the Customer is obliged to make the payment within 24 hours from the date of conclusion of the Sales Agreement.
* Transaction data such as credit card type, number, expiration date, CVV number (three-digit code on the back of the credit card) are entered on a secure page encrypted via an SSL connection.
§6 Costs, methods, and delivery time.
1. Delivery of the Product to the Customer is payable, unless the Sales Agreement states otherwise.
Product delivery costs (including transport, delivery and postal services fees) are indicated to the Customer on the Online Store's pages in the "Delivery and payments" tab and during the order placement, including at the moment when the Customer expresses the will to be bound by the Sales Agreement.
2. The Seller provides the Customer with the following Product delivery methods:
- Courier delivery,
- Cash on delivery courier delivery.
3. The delivery time of the Product to the Customer is up to 1-7 business days within Poland, up to 14
business days within Europe, and up to 21 business days outside Europe, unless a shorter period is specified in the description of a given Product or during the order placement. In the case of Products with different delivery times, the delivery time is the longest specified period, which, however, cannot exceed the indicated periods. The start of the Product delivery period to the Customer is calculated as follows:
I In the case of the Customer choosing payment by bank transfer, electronic payment or credit card - from the date the Seller's bank account or settlement account is credited.
The processing time for HAND MADE sweaters is 14 business days* if the time is longer we will definitely inform the Customer.
II In the case of the Customer choosing cash on delivery payment method – from the date of conclusion of the Sales Agreement
4. Shipping costs:
I. Within Poland, if the cost of the ordered goods does not exceed PLN 399 gross - PLN 10 (via InPost Parcel Lockers); PLN 15 (via InPost courier), PLN 20 (via DPD courier), PLN 25 (via DPD cash on delivery courier)
II. Within the European Union PLN 89, and outside EU countries PLN 110.
§7 Product complaint.
The basis for returning a product or making a complaint is to provide us with a printed and completed return form and a document confirming the purchase.
1. The basis and scope of the Seller's liability to the Customer, if the sold Product has a physical or legal defect (warranty), are defined by generally applicable provisions of civil law, in particular those specified in the Civil Code.
2. The Seller is obliged to deliver the Customer a Product free from defects.
3. Complaints may be submitted by the Customer via email to: kontakt@angell.pl or in writing to: REKLAMACJE ANGELL, ul.Ratajczaka 45, 61-728 Poznań,
4. It is recommended that the Customer provides in the complaint description: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the defect; (2) a request for how to bring the Product into conformity with the Sales Agreement or to withdraw from the Sales Agreement; and (3) contact details of the complainant – this will facilitate and speed up the consideration of the complaint by the Seller. The requirements specified in the preceding sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description.
5. The Seller shall respond to the Customer's complaint immediately, no later than within 14 calendar days from the date of its submission. Failure of the Seller to respond within the aforementioned period means that the Seller has acknowledged the complaint as justified.
§8 Out-of-court settlement of complaints and claims.
1. The consumer may use out-of-court methods of complaint resolution and claim enforcement. To use the possibility of amicable resolution of disputes regarding purchases made through our website www.angell.pl, in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013
on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on ODR in consumer disputes) - the Consumer may submit their complaint, e.g., via the EU ODR online platform, available at: http://ec.europa.eu/consumers/odr/" or through mediation (detailed information on the possibility for the Buyer who is a Consumer to use out-of-court methods of complaint resolution and claim enforcement, as well as rules of access to these procedures, are available at https://uokik.gov.pl/wazne_adresy.php#faq595, as well as at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection, and the Office of Competition and Consumer Protection).
2. The European ODR platform is intended to facilitate independent, impartial, transparent, effective,
quick and fair out-of-court online resolution of disputes between consumers and traders concerning contractual obligations arising from online sales contracts or service contracts concluded between consumers residing in the European Union and traders established in the European Union.
3. The use of available out-of-court methods of complaint resolution and claim enforcement is possible after the completion of the complaint procedure and is voluntary -
Both parties must agree to the proceedings. The Seller agrees to the use of out-of-court dispute resolution with Consumers.
§9 Right of withdrawal from the Sales Agreement.
A consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring costs, except for delivery costs. To meet the deadline, it is sufficient to send a statement before its expiry. The statement of withdrawal from the contract may be submitted electronically via email to: kontakt@angell.pl.
A sample withdrawal form is available in the returns tab on the angell.pl website. The period for withdrawal from the contract begins: for a contract under which the Seller releases a Product, being obliged to transfer its ownership (e.g., Sales Agreement) – from the consumer taking possession of the Product or a third party indicated by them other than the carrier, and in the case of a contract that: (1) covers many Products that are delivered separately, in batches or in parts – from taking possession of the last Product, batch or part, or (2) consists of regular delivery of Products for a specified period – from taking possession of the first Product; for other contracts – from the date of concluding the contract.
In the event of withdrawal from a distance contract, the contract is considered null and void.
The Seller is obliged to immediately, no later than within 14 calendar days from the day of receiving the consumer's statement of withdrawal from the contract, return the payments made by the consumer. The Seller shall refund the payment using the same payment method as used by the consumer, unless the consumer has expressly agreed to a different refund method that does not involve any costs for them. If the Seller has not offered to collect the Product from the consumer themselves, they may withhold the refund of payments received from the consumer until they receive the Product back or until the consumer provides proof of its return, whichever occurs first.
The consumer is obliged to immediately, no later than within 14 calendar days from the day on which they withdrew from the contract, return the Product to the Seller or hand it over to a person authorized by the Seller to collect it, unless the Seller offered to collect the Product themselves. To meet the deadline, it is sufficient to send back the Product before its expiry. The consumer may return the Product to the address: ANGELL, ul.Ratajczaka 45, 61-728 Poznań. The consumer is liable for any diminished value of the Product resulting from using it in a manner exceeding what is necessary to establish the nature, characteristics and functioning of the Product.
Possible costs associated with the consumer's withdrawal from the contract, which the consumer is obliged to bear:
If the consumer chose a delivery method for the Product other than the cheapest ordinary delivery method available in the Online Store, the Seller is not obliged to refund the additional costs incurred by the consumer.
The consumer bears the direct costs of returning the Product.
HAND MADE products created to order for the customer, therefore individualized products are not subject to return.
Product returns can be made:
- in a way chosen by the Consumer (via courier company or post; independent generation of a consignment note and return shipment)
- The Consumer can use szybkiezwroty.pl.
a) Just go to www.szybkiezwroty.pl, search for the angell.pl store and fill out the form. You will receive an SMS with a parcel locker code to the indicated phone number, which is valid for 72 hours. If the code expires, you can generate it again.
b) Then go to any parcel locker. Select "Send parcel" on the screen, then "I have a sending or return code" - enter the code from the previously received SMS.
c) Place the parcel in the box, close the door and that's it! You can track your return on the InPost website,
§10 Provisions concerning entrepreneurs.
This point of the Regulations and its provisions apply exclusively to Customers and Service Recipients who are not consumers.
The Seller has the right to withdraw from a Sales Agreement concluded with a Customer who is not a consumer within 14 calendar days from the date of its conclusion. Withdrawal from the Sales Agreement in this case may occur without giving a reason and does not create any claims on the part of the Customer who is not a consumer against the Seller.
In the case of Customers who are not consumers, the Seller has the right to limit available payment methods, including requiring full or partial prepayment, regardless of the payment method chosen by the Customer and the fact of concluding a Sales Agreement.
Upon the Seller handing over the Product to the carrier, the benefits and burdens associated with the Product, as well as the risk of accidental loss or damage to the Product, pass to the Customer who is not a consumer. In such a case, the Seller is not responsible for the loss, deficiency, or damage to the Product arising from its acceptance for transport until its delivery to the Customer, and for delays in the transport of the shipment.
If the Product is sent to the Customer via a carrier, the Customer who is not a consumer is obliged to examine the shipment at the time and in the manner customary for such shipments. If they find that there has been a deficiency or damage to the Product during transport, they are obliged to take all necessary steps to establish the carrier's liability.
In accordance with Article 558 § 1 of the Civil Code, the Seller's liability under warranty for the Product towards a Customer who is not a consumer is excluded.
In the case of Service Recipients who are not consumers, the Service Provider may terminate the electronic service agreement with immediate effect and without stating reasons by sending the Service Recipient an appropriate statement.
The liability of the Service Provider/Seller towards a Service Recipient/Customer who is not a consumer, regardless of its legal basis, is limited – both within a single claim and for all claims in total – to the amount of the price paid and delivery costs under the Sales Agreement, but not more than one thousand Polish zlotys. The Service Provider/Seller is liable towards a Service Recipient/Customer who is not a consumer only for typical damages foreseeable at the time of concluding the agreement and is not liable for lost profits towards a Service Recipient/Customer who is not a consumer.
Any disputes arising between the Seller/Service Provider and the Customer/Service Recipient who is not a consumer shall be subject to the jurisdiction of the court competent for the registered office of the Seller/Service Provider.
§11 Personal data protection.

2. Personal data is protected in accordance with the Act of 29.08.1997 on the protection of personal data (Journal of Laws No. 101 of 2002, item 926, as amended) in a manner that prevents third parties from accessing it.
3. Personal data is processed on www.angell.pl in accordance with the provisions of the Act of August 29, 1997 on the protection of personal data and Articles 16-22 of the Act of July 18, 2002.
providing services by electronic means, for purposes related to conducting commercial and service activities.
4. By creating a user account or placing a one-time order, the Buyer agrees to the placement of their personal data in the database and to its processing for the purpose of fulfilling the product sales agreement. Providing personal data by the Buyer is voluntary, but refusal to consent to its processing prevents the order from being fulfilled.
5. Buyers' personal data may be transferred to entities authorized to receive them under applicable law and, in the event of non-payment of amounts due to ANGELL, to entities conducting recovery proceedings on its behalf.
6. If the Buyer gives additional consent, their personal data will be processed by www.angell.pl for the purpose of informing about new goods, promotions, and services.
7. Buyers have the right to inspect their personal data, correct it, and request its removal at any time.
§12 Final provisions.
1.Agreements concluded through the Online Store are concluded in Polish.
2.The Seller reserves the right to make changes to the Regulations for important reasons, i.e.: changes in legal provisions, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller will inform the Customer of each change at least 7 days in advance.
3.In matters not regulated by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of electronic services; the Act on consumer rights, the Act on personal data protection.
4.The Customer has the right to use out-of-court complaint and claim resolution methods. For this purpose, they can submit a complaint via the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
